O R D E R
NAWAB SINGH J,
The instant appeal has been filed by Ashok Kumar Virdi -complainant (appellant) against the order dated January 06th, 2016 passed by District Consumer Disputes Redressal Forum, Panchkula (for short ‘District Forum’). For ready reference, operative part of the order is reproduced as under:-
“5. For the reasons recorded above, the complaint is allowed. The Ops are jointly and severally directed to refund the annuity amount of policy No.174243987 alongwith interest @ 9% per annum from the date of maturity till realization of the amount. The ops are also directed to pay Rs.5000/- to the complainant as costs of litigation. The abovesaid order shall be complied with within 30 days of its receipt by the opposite parties.”
2. On January 28th, 2005 complainant obtained Jeevan Nidhi Policy from Life Insurance Corporation of India (LIC). The date of maturity was January 28th, 2015. The LIC did not pay the maturity amount despite repeated reminders and supply of requisite documents by the complainant.
3. The complaint was accepted by the District Forum and issued direction to the builder as mentioned in paragraph No.1 of this order.
4. The complainant has challenged the impugned order on the grounds that interest awarded should have been 12% per annum from the date of maturity instead of 9% per annum; Rs.20,000/- litigation expenses instead of Rs.5000/- alongwith Rs.50,000/- compensation.
5. The District Forum has not only awarded interest at the rate of 9% per annum from the date of maturity till its realization but also awarded Rs.5000/- litigation expenses to the complainant. This being so, the complainant has been adequately compensated and as such, no case for interference in the impugned order is made out.
6. The appeal is therefore dismissed.
