Statement of Sh.Sushil Mehta, Adv. Counsel for the Complainant recorded that the Complainant has already received an amount of Rs.26,648/- from the OPs along with accrued interest.
As per order of this Commission and Hon'ble State Commission, total amount Rs.5,07,000/- was deposited by the OPs, for payment to the complainant. Out of Rs.5,07,000/-, the complainant has already received Rs.25,000/- alongwith interest total Rs.26,648/-. Thus amount payable to Complainant comes (Rs.5,07,000/- minus Rs.25,000/-) Rs. 4,82,000/- .
As per report of Bill Clerk, in this case, there are two FDRs for Rs.2,50,000/- each. As per report of Bill Clerk, Rs.18,000/- have been deposited by the OP, in excess. The Superintendent is hereby directed to break the said FDRs and after realisation the amount along with accrued interest be released to the complainant against proper receipt as per law.
An amount of Rs.4,82,000/- alongwith proportionate interest be paid to DH and remaining amount of Rs.18,000/- alongwith proportionate interest be paid to OPs/LIC. The present miscellaneous application is disposed of . File be consigned to the record room.
