An application has been moved by the applicant for releasing of Rs.6,97,458/- deposited by the OPs at time of filing appeal along with interest.

Report of Ahlmad was called. As per report of Ahlmad, Rs.7,20,998/- have been received from Hon'ble State Commission and has been kept in shape of FDR. Notice of the application was issued to the OP. Sh.Kunwar Sood, Adv. Counsel for the OP has appeared on behalf of OP and made a statement that they are in process of filing appeal against the order dated 20.03.2024 before the Hon'ble National Commission and request has been made to grant 20 days time.

Perusal of record shows that the complaint of the complainant was partly allowed by this Commission vide order dated 19.05.2023. Appeal filed by the OP was dismissed by the Hon'ble State Commission vide order dated 20.03.2024. The complainant was directed that "they may approach the District Commission for release of the amount deposited by the OP at time of filing appeal and the District Commission may pass appropriate order in this regard after expiry of limitation period in accordance of law'.

As per report of Ahlmad, as per order passed by Hon'ble State Commission dated 20.03.2024, appeal was dismissed and period of 45 days for filing of appeal has already lapsed. As per online checking by Ahlmad, no appeal has been filed by the OPs before the Hon'ble National Commission as yet. The limitation period has expired and no appeal has been filed. In such circumstances, the amount deposited by the OPs before Hon'ble State Commission and received from the Hon'ble State Commission is ordered to be released to the complainant. The Superintendent is directed to break the FDR and after releasing the amount along with accrued interest thereon be released to the Complainant against proper receipt as per rules. File be consigned to the record room.
