Parties are present with both the petitioner with Ld. Advocate Nabanita Pandey and Ld.Advocate,  A Pramanik for O.P. Nos. 1 to 7. Petitioner filed a petition praying for dismissal of the case as the dispute is settled and decided outside the case. Copy served on O.Ps with no objection. Petitioner also signed over the petition for receiving the cheque  paid by O.Ps.

          O.Ps 1 to 6 filed a petition stating about settlement of the case issuing a Account Payee Cheque being No. 027984 dt. 26.02.2015 on ICICI Bank, Jalpaiguri Branch of Rs. 498500/- in favour of petitioner – Chumki Kundu along with a xerox copy of the cheque signed by Chumki Kundu endorsing receiving of the cheque and prayed for disposal of the case for non-prosecution.

          Petitioner Chumki Kundu in presence of her Ld. Lawyer Nabanita Pandey  and Ld. Lawyer  A.K. Pramanik of O.Ps submitted before Forum that she has received a cheque of Rs. 498500/-  as above and is satisfied in full.

          As the dispute of the case of Malda D.F.C. No. 78/2014 has been settled outside between the parties outside Forum, the case is dismissed as per appeal of both parties for non-prosecution.  

          Hence,                                     ordered

that  Malda D.F.C. No. 78/2014 is dismissed for non-prosecution.
