ORDER

Shri Iqbal Ahmed, learned counsel for the appellant.

          Heard on admission.

We have perused the order passed by the District Consumer Forum, Jabalpur in case no.461/14 dated 26.08.15, wherein the Forum has very elaborately described the situation prevailing in this case.

Counsel for the appellant argued that the proposal form Annex. R-2 was not filled by the appellant. It was the Agent who had filled the proposal form’s column 11A – 11J.  He submitted that the appellant was neither suffering from any disease nor was being treated for any disease at the time of taking the policy.

The District Forum did not agree with this fact.  As per the District Forum, the form was filled according to the information provided by the appellant.  Hence, there was no relevancy in this fact. The appellant did not reveal his true health status at the time of the policy.

The District  Forum has rightly concluded that there is no deficiency on the part of the respondent – Insurance Co. in repudiating the claim of the appellant

The order passed by the District Forum is quite genuine.   There is no infirmity in the order passed by the District Forum and needs no interference at all.

The appeal filed by the appellant has no weight. The appeal is therefore dismissed at the admission stage itself.
