Complainant-petitioner is the nominee of the insured. The insured had taken a policy of Rs.50,000/- on 22nd December, 2001 and died on 6th October, 2003. The petitioner filed the claim with the Insurance Company which was repudiated on the ground that the deceased was suffering from lever disease before taking of the insurance policy. The District Forum allowed the complaint, aggrieved against which the respondent filed an appeal before the State Commission. The State Commission has reversed the order of the District Forum relying upon the report of S.G.P.G.I., Lucknow. The diagnosis in the S.G.P.G.I. was as under: - “FUC of clrrhosis (B & C-ve), alcoholic, PHT with controlled ascites Alcohol consumer in cirrhogenic does * 11 years, abstinent * 4 months (last intake 24 Jan 03 h/o bleed twice-19 feb 03, mar 03 received 1 PRB Ceach time in SGPGI. On EST no h/o HE, last UGIE * 24/05/0 gr 1 eso vx/ night blindness –1 year presented with melena * 7 days, increased since 2 days no hematemasis/alteredsensorium/oliguria BH 5.6 reached 2 BT at Gorakhpur.” We agree with the view taken by the State Commission. The revision petition is accordingly dismissed.
