SRI.P.V.JAYARAJAN: PRESIDENT
This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service and unfair trade practice on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The opposite parties 1 & 2 entered appearance and filed written version denying the allegation raised by the complainant. Meanwhile when the case came up for consideration on 25/09/2023, the complainant’s counsel submitted that the complainant is no more and hence the case was subsequently adjourned for taking steps and also to ascertain whether the legal heirs of the deceased complainant are willing to proceed with this complaint or not. Since 25/09/2023 number of adjournment were granted for steps to implead the legal representative of the complainant by themselves. Inspite of giving sufficient opportunities, none of the legal heirs of deceased complainant come forward to implead themselves for the purpose of proceeding further with this complaint. In the above circumstances we find that the legal heirs of deceased complainant are not interested to further proceed with this complaint.
In the result complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
