ORDER

Fora below have dismissed the complaint filed by the complainants on the ground that the insured (deceased) was guilty of

suppression of material facts while filling in the proposal form.  While dismissing the complaint, the State Commission had awarded Rs.20,000/- by way of ex-gratia payment. 

          We had directed the counsel for the petitioner insurance company to get instructions regarding payment of ex-gratia amount to the respondents.  Learned counsel for the petitioner insurance company after taking instructions states that the insurance company is agreeable to pay Rs.20,000/- to the respondents by way of ex-gratia payment.

          In view of the statement made by counsel for the insurance company, revision petition 1244/2010 is dismissed.

          Revision petition 1357/2010 has been filed by the complainants.  We agree with the view taken by the fora below that the deceased was guilty of suppression of material facts; that the deceased did not act in good faith and disclose the material facts regarding the disease from which he was suffering, while filling in the proposal form.  Dismissed.
