ORDER

This order is pronounced in the open Forum on separate sheets of paper today. The complaint is allowed. The complainant is held entitled to the amount of Rs.40,000/- together with additional sum equal to the sum assured i.e., Rs.40,000/- under the policy in question as the death was due to the accident as contemplated under the policy. Further the complainant is held entitled to Rs.2,500/- as the compensation for mental and physical agony suffered by her from the first respondant. Further the complainant is held entitled to interest on Rs.80,000/- being the award amount due under the policy at the rate of Rs.12% p.a. and Rs.500/- towards the costs of this proceedings from the 1st respondant. Complaint against the 2nd respondant is dismissed. The respondants shall bear their own costs. Send the certified copies of this judgement and order to both sides parties by RPad immediately.
