Neither any one appears for the petitioner nor defects pointed out by the Registry in this revision petition have been removed by the petitioner.  Rather he has made request through post for waiving off the said objection and to decide the matter on the strength of the material supplied by him, on the ground that he has financial constraints and is an indigent person and unable to meet the requirements.  As a special case, we are inclined to decide the

petition.  Having considered the matter, we are of the considered opinion that the orders passed by the fora below are eminently justified and are strictly in accordance with the settled legal position in as much as the insured wife of the complainant died at a time when the policy was lying lapsed and therefore, as per the Rules, the Life Insurance Corporation was not liable to pay the insurance amount.  However, keeping in view the financial constraints of the complainant, we would like the Life Insurance Corporation of India to consider the case of the complainant sympathetically for refund of the premiums received by it alongwith some reasonable interest.

With these observations, the revision petition is disposed of.
