JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT

The complainant in CC.81/08 in the file of CDRF, Idukki is the appellant.   The complaint was dismissed.
It is the case of the complainant that he is the nominee of the policy held by his deceased wife.
The LIC rejected the claim directing the petitioner to produce the legal heir ship certificate. It is also seen that he was having strained relation ship with the deceased.   A criminal case in this regard was pending before the JFCM Court, Kanjirappally and another case before the Family Court, Ettumanoor. The children had filed another petition claiming the amount.
The Forum has held that the matter exclusively pertains to a civil dispute.
We are in agreement to the finding of the Forum. The appellant can resort to civil remedies before the appropriate forum.
In the result the appeal is dismissed in limine.
The office is directed to dispatch the copy of this order to the Forum urgently.
