During the course of arguments, it has been pointed out by the ld.counsel for the opposite party that opposite party has taken specific plea in the written version that complainant never intimated to the opposite party regarding death of the insured Ramesh Kumar nor lodged any claim with the opposite party nor the complainant has mentioned any date, month or year when the complainant lodged claim regarding death of Ramesh Kumar insured, with the opposite party. The opposite party is ready to decide the claim case of the complainant if the claim is lodged alongwith requisite documents with the opposite party by the complainant. Ld.counsel for the complainant submitted that the complainant is ready to lodge claim alongwith requisite documents with the opposite party.

So, with the consent of the counsel for the parties, present complaint is disposed of with directions to the complainant to lodge claim on the prescribed claim form alongwith requisite documents regarding death of the insured Ramesh Kumar under the policy in question, within one month from the date of receipt of copy of orders and the opposite party is directed to decide the claim case of the complainants regarding death of the insured Ramesh Kumar within two and half months from the date of receipt of claim alongwith requisite documents from the complainant. Keeping in view the peculiar circumstances of the case, parties are left to bear their own costs. Copies of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
