ORDER

The complainant is present. The opposite party's advocate along with the opposite party present. The complainant submits that whatever he paid as premium may be refunded by LIC. But the opposite party submits that the policy is lapsed because of non payment of premium. The complainant paid the premium only for two years and that the policyhas been covered wtih the risk. And that therefore no refund could be granted. More over the complainant has alleged a forgery in respect of the policy which can not be adjudicated by this Forum. The counsel for the opposite party has relied on II(1991) CPJ 538 where in it has been held that insurance policy cannot be called in question on the ground of misstatement after two years. Having regards to the facts and circumstances of the case this Forum has no jurisdiction to entertain this complaint. And as such the complaint stands dismissed. The complainant is at liberty to approach any other competent Forum or civil court for his redressal.
