29/07/2024: The petition being numbered 259/24 bereft of Vakalatnama has been filed on behalf of the complainant praying time on ground stated thereunder to file evidence of the complainant. Opp. Party present through its ld. counsel has verbally objected to the lineal adjournment taking place in the case. Gone through foregoing Orders, more particularly the order passed on the last date. The ground of the complainant being out of station, as taken under the instant petition is also not convincing as, had the complainant been serious of her position in the proceedings considering the caution issued to her on the last date, she could have filed her evidence-on -affidavit within the intervening period till date. From the behaviour of the complainant it appears that the complainant lacks the required diligence and interest in her case. The instant petition for further adjournment in the light of foregoing orders can no longer be entertained. The same accordingly stands rejected while the case simultaneously stands dismissed for default.
