ORDER

The Counsel representing the opposite party opposed for awarding of cost. On the ground that the opposite party had issued a notice to the heirs of the deceased to produce documents to prove their relationship with the deceased to handover the documents and the complainant did not respond, but has rushed to the Forum and therefore contended that the complainant is not entitled for any cost. After hearing the counsel for both the parties, we have perused the record. It is undisputed that the loanee had repaid part of the loan amount during his life time who died latter. At that stage, the opposite party appears to have searched the heirs of the deceased called them and recovered the entire balance amount and said to have issued even clearance certificate also. The opposite party admitedly is having its field officers for collection of information required by the opposite party.
