        Learned Counsel Sri K P Tiwari appeared alongwith learned Counsel Mr. Malik Faiyaz Ahmad for complainant.

Heard learned Counsel for the complainant and perused complaint.

By means of this complaint the complainant has prayed following reliefs for redrssal of his grievance.

1. Order the opposite parties to ensure to re-issue the insurance policy afresh of the vehicle bearing registration number UP-32-DQ-4686 FORD FIGO of the complainant.
2. Order the opposite parties to pay Rs.25,05,000/- as compensation of mental and physical harassment as well as

:2:

 professional loss caused by the respondents/Insurance Company.

3. Order the opposite parties to pay Rs.25,000/- as the cost of complaint.

Annexure 5 of complaint is the letter dated 06-11-2018 sent by opposite parties to complainant whereby opposite parties have informed that the insurance policy in question of complainant has been reinstated for the period extending from 17-03-2018 to 16-03-2019. Thus, it is apparent from this letter that the above relief ‘A” claimed in complaint has already been granted to complainant by opposite parties.

Relief ‘B’ is mainly based on relief ‘A’ and cancellation of insurance policy which has already been reinstated.

At this stage learned Counsel for the complainant submitted that the opposite parties have not decided claim of complainant in respect of above insurance policy.

Learned Counsel for the complainant submitted that the complainant wants to withdraw the complaint with liberty to file fresh complaint regarding his insurance claim arising out of above policy.

In view of above complaint is dismissed with liberty to complainant to file complaint before competent forum for redressal of his grievance arising out of his claim in respect of above mentioned insurance policy.

Let copy of this order be made available to the parties positively within 15 days as per rules.
