Heard Sh. Dhruv Sehgal, proxy Counsel on behalf of Ms. Deepa Chacko, Counsel for OP. Perused file. It is true that none is appearing for the complainant since last dates of hearings i.e.24.07.2019&23.10.2019 consecutively. Several calls have been given since morning. But none on behalf of the complainant has appeared. Moreover, Counsel for OP submitted that the complainant has failed to file complainant’s evidence by way of an affidavit despite giving opportunities on 21.03.2018, 23.07.2018, 31.10.2018, 06.03.2019, 24.07.2019 & 23.10.2019.

It appears that the complainant is not interested in pursuing his case. It will be abuse of process to proceed further in the absence of the complainant. Hence complaint is dismissed in default for the reasons mentioned above. File be consigned to record room.
