O R D E R

The complainant has filed the present complaint against O.Ps under section 12 of the Consumer Protection Act, 1986.  The facts as alleged in the complaint are that complainant purchased LG Dios refrigerator make GR-B207DLC J9L701KRSB00014 vide invoice no.R018452 from O.P-2 on 28.06.2007. It is alleged that the refrigerator from inception of its purchase was not working properly and was a defective piece and it is alleged that despite repeated complaints to op-2, it charged exorbitant charges for the repairs. It is alleged that after 9 months of purchase of the product in dispute there was reduction in cooling and with time the refrigerator totally stopped cooling. It is alleged that 24.07.2009 OP-1 authorized service center charged a sum of Rs. 1490 for gas charging and drier. It is alleged again on 28.04.2010 the same problem persisted for which amount of Rs.1491/- was charged for the same purpose. It is further alleged that on 29.05.2011  the product in dispute had problem with cooling. On lodging complaint engineer Mr. Karan visited the premises and told the complainant that the compressor is faulty and same was replaced which was within warranty but OP again charged Rs. 1490/- for refilling the gas and for direr. It is alleged that even after replacing faulty compressor the coil/condenser unit developed fault and the refrigerator stopped working and the complainant had to face difficulty in peak summer days. The complainant again contacted OP and Mr. Karan Engineer, after inspecting the refrigerator, told that the internal body pipes needed to be replaced and informed that installing the grills outside the unit is only solution of this problem. It is alleged that after installing the grill on the outside and cutting the internal body pipes the refrigerator no longer functioned as Dios refrigerator and would be like any other normal refrigerator the complainant alleged that the purpose of buying refrigerator with feature dios is defeated.  It is alleged that the complainant requested for the replacement of the faulty refrigerator but of no avail. It is alleged that the complainant had also written to Manger of LG electronics Pvt. Ltd. Vide email dated 24.06.2011 and requested to redress his grievance by replacing the product or refunding the entire amount. But to no effect. Hence the present complaint for directions to refund a sum of Rs. 54,500/- cost of refrigerator and pay a sum of Rs. 50,000/- as compensation on account of mental and physical agony and harassment and Rs. 40,000/- as litigation charges.                   

         Notice of the complaint was sent to the Ops. None put in appearance on behalf of Ops-1 and 2 despite service so they are proceeded ex-parte vide order dated 01.04.2016 and 03.05.2016.   

        Complainant has filed his affidavit in evidence testifying all the facts as alleged in the complainant. He relied on annexure C-1  copy of invoice dated 28.06.2007, annexure C-2 copy of invoice dated 24.07.2009, annexure C-3 copy of invoice dated 28.04.2010 annexure C-4 invoice 29.05.2011 and annexure C-5 letter dated 24.06.2011.    

        We have carefully gone through the record of the case and have heard submission of complainant.

        The case of the complainant is that he purchased dios technology refrigerator which is not working from the very inception and within 9 months of the purchase there is reduction in cooling. The complainant has placed on record duplicate invoice dated 28.06.2007 which showed that he purchased LG refrigerator of make 207DLC for sale consideration of Rs.54500/-. Annexure C-2 shows that the complaint was first time lodged on 24.07.2009 approximately two years, whereby Rs. 1490/- was charged for refilling gas and drier and again on 28.04.2010 approximately after nine months the gas was refilled and charged for drier and annexure C-4 also shows the gas was refilled on 29.05.2011 after eleven months the gas is refilled. The complainant alleged that there is reduction in cooling and internal pipes were changed by installing the grill outside which is not supported by any cogent document. He is unable to support his version that the refrigerator from of very inception of purchase was defective hence complainant miserably failed to establish his case. Therefore, there was no deficiency of service on the part of O.Ps hence the complaint is devoid of merit and resultantly dismissed.   

        Copy of this order be sent to the parties as per rules.
