ORDER

13-07-2009 Present : Sh. H.S. Mahal, Advocate, counsel for the complainant Sh. Jasbir Singh, Advocate, counsel for opposite party No. 1 None for opposite party No. 2. Learned counsel appearing on behalf of opposite party No. 1 stated at Bar that opposite party No. 1 does not intend to file any reply and infact opposite party No. 1 is ready to replace the Lenovo NB62Q(Laptop) purchased by the complainant from opposite party No. 2 vide Invoice No. 185 dated 17-04-2008 with a brand new one of the same model and fresh warranty and opposite party No. 1 does want to contest the claim of the complainant. He also made a statement to this effect which is recorded separately. Opposite party No. 2 has also filed written statement to the claim of the complainant but has not come forward thereafter and as such, was proceeded against exparte. The complainant was present in the Forum with his counsel and the statement of Sh. H S Mahal, Advocate, counsel for the complainant was also recorded who stated that complainant may also be compensated adequately for mental tension agony, harassment and legal expenses which he has incurred in prosecuting this complaint. After taking into consideration the fact that opposite party No. 1 has admitted the claim of the complainant and opposite party No. 2 is proceeded against exparte, and in view of the statement made by the learned counsel for opposite party No. 1, opposite party No. 1 is directed to replace the “Lenovo NB62Q Laptop” purchased by the complainant from opposite party No. 2 vide Invoice No. 185 dated 17-04-2008 with a brand new model of the same quality and facilities and also with a fresh warranty. In addition to this, both the opposite parties shall also be liable to pay jointly/severally an amount of Rs. 1500/- as compensation to the complainant on account of inconvenience, harassment and mental tension etc., and an amount of Rs. 500/- as litigation expenses. The compliance of this order be made within a period of one month from the date of receipt of copy of this order. Copy of this order be sent to the parties concerned free of cost and file be consigned. Member Member President D.C.F.
