               Today is fixed for admission hearing. Complainant moves the admission matter through E-hearing (through video conference).

               Heard the complainant. Perused the materials on record and considered.

          It appears that the complainant Sayan Mondal has filed this complaint on behalf of his cousin brother Shantanu Maity who, actually, purchased the production. As such, the complainant is not a consumer in terms of section 2(7) of the C.P. Act 2019. On the other hand, Shantanu Maity is a resident of Kolkata. The OP has  address at Howrah, West Bengal. So, both the seller and buyer have the address outside the territorial jurisdiction of this commission. The case can not be entertained in terms of section 34(2)(a) of the C.P. Act.  

              In view of the above, we are of the opinion that there is no scope to entertain this complaint, which is liable to be dismissed as not admitted.

              Hence, it is

              that the CC No. 77/2023 be and the same is dismissed as not admitted.
