1. This order shall dispose off an application dated 31.05.2023 filed by the AR of the Complainant for restoration of the case. It is stated in the application that on 11.04.2023 this case was dismissed for non-appearance. It is further stated that the Complainant was not well for long time and he had undergone a surgery. It is stated that due to the said reason the Complainant could not appear in the court. It is prayed that the complaint be restored. We have heard Shri Parvesh, the AR of the Complainant and have perused the file. The case of the Applicant/Complainant is that he could not appear as he was not well. Along with the application some copies of the medical documents have been attached and the perusal of the same shows that the said documents do not pertain to the Complainant i.e. Rahul Kumar. The said documents pertain to one Mr. Parvesh. Whereas in the application it is stated that the Complainant was not well. The perusal of the file further shows that Complainant was not regular in appearance. The Complainant has appeared lastly in the court on 20.05.2022. Thereafter, he did not appear on any date. Therefore under these circumstances we do not see any merit in the application and the same is dismissed.
