ORDER

Heard learned advocate for both the parties and perused the record. Admittedly complainant is entitled to payment of 45% of the premium only alongwith interest in the light of the terms and conditions of the policy as mentioned in premium allocation rate. Since the premium of 10000 only has been paid once only. Therefore the complainant is entitled to Rs. 4500/- only with interest up to date. 

 Hence, the OP is directed to pay the sum of Rs. 4500/- with simple interest @ 6% per annum from the date of deposit till the date of payment plus a sum of Rs. 2000/- as compensation for the mental agony and physical harrasment suffered plus a sum of Rs. 1000/- as the cost of litigation. Above amount must be paid to the complainant within 90days from the date of this order.

Let a true typed copy of this order be immediately served to both the parties individually or through their respective authorised advocates on the record.
