During the pendency of the present appeal, the parties have arrived at a compromise.

A joint compromise application has been filed by the parties, wherein it has been stated that the respondent has agreed to accept sum of Rs. 2,81,746/-, the total surrender value of the policy, towards full and final settlement of his claim.

Therefore, the appeal is decided in terms of the compromise arrived between the parties.  The compromise application shall form part of the order.  The payment of the above sum of Rs. 2,81,746/- shall be made by the appellant to the respondent within a period of 30 days’ from the date of this order.  After payment of the above amount is made by the appellant to the respondent, the statutory amount of Rs. 25,000/- deposited by the appellant at the time of filing the appeal, be released in its favour.
