ORDER

Sunil Mulodia Vs. Manager Leayan  Global Pvt. Ltd. & Anr.

 

Present:           Complainant in person.

                        Sh. Baljor Ram, Advocate for OPs/applicant.

 

                        Complainant tendered in exparte evidence his affidavit Ex.CW1/A alongwith documents Ex. C-1 to Ex. C-3 and closed the evidence.

                        Ld. counsel for OPs moved an application coupled with power of attorney for setting aside exparte proceedings against them.  The case is adjourned to 01.05.2024 for filing reply to the said application as well as for consideration.

                        At this stage, the counsel for OPs got recorded his statement that they are ready to pay Rs.6000/- (Rs. Six thousand) to the complainant by 01.05.2024 otherwise the amount will be payable by adding interest @ 12%.

                        Complainant has also got recorded his statement that in view of the aforesaid statement, he withdraw the present complaint while reserving his rights to restore the present complaint.

                        In view of the statements, the complaint stands disposed of. The parties shall remain bound by their statements made today.  It is made clear that in case of default, the Ops shall liable to pay simple interest @ 12% per annum on the aforementioned amount after 01.05.2024 till its realization. Further, the complainant shall also have right to restore the present complaint, as per rules. Certified copies of this order be sent to the parties concerned, as per rules, free of costs.  File after due compliance be consigned to the record room.
