          None for the appellants is present. Its counsel are also absent. However, Adv. Ms Dipali Diyewar appeared on behalf of Adv. Mr Bhangde for the appellants and filed Pursis, seeking adjournment on the ground that the matter is likely to be compromise between the parties.

               On the basis of such Pursis adjournment cannot be granted. The appellants ought to have filed an application for adjournment. Without prayer adjournment cannot be granted. 

              Adv. Mr. V. Kulsange for the respondent is present and submitted that he has no instructions from his client for settlement. 

        On perusal of record, we find much substance in the submission of Adv. Mr Kulsange for the respondent. 

           On perusal of record it reflects that the appellants as well as its counsel are not attending the matter regularly. On last date also, none appeared for the appellants. Today also the appellants as well as its counsel are absent. However, they have only sent Pursis, seeking adjournment, which cannot be considered. 

              No order as to cost.
