Per Justice Shri S.B.Mhase, Hon’ble President:

Heard.  By order dated 19/11/2010 M.A.No.10/431 in F.A.No.10/830 was allowed on payment of cost of `5,000/- to be paid within four weeks from the date of order.  It was made clear in the said order that if the appellant/applicant failed to pay the above cost to the respondent/complainant, the appeal will automatically stands disposed of being barred by limitation. 

Counsel for the complainant and complainant both are present.  Counsel for the complainant also makes a statement that amount has not been deposited and/or paid to the opponent/complainant.  Appellant’s Counsel has not demonstrated any material that amount has been paid.  Therefore, as per the order for non-compliance of the directions, appeal stands disposed of as time barred.  Hence, we pass the following order:-

1.       Appeals stands disposed of as time barred.

2.       No order as to costs.

3.       Dictated on dais.

4.       Copies of the order herein be furnished to the parties as per rule.
