ORDER NO. 3 DT. 4.12.09

Heard Mr. Arnab Mukherjee, Ld. Advocate for the Revisionist and Mr. Purnasish Roy, Ld. Advocate appearing on behalf of the OP No. 1 by filing Vokalatnama today.  It appears that the impugned order was passed rejecting the prayer for addition of party.  The Ld. Advocate for the Revisionist argues that the subject matter of the proceeding being a power tiller the presence of the manufacturer is required for deciding the technical aspects as regards the said power tiller.  The Ld. Advocate for the OP No. 1 vehemently opposes such prayer.

We have considered the contention and we find that no case has been made out by the Revisionist showing that the manufacturer is a necessary party in the proceeding.  The agreement under which the power tiller was taken was between the complainant and the present Revisionist.  Therefore, for the purpose of ascertaining the technical aspect appropriate evidence can be adduced by any party requiring the same and for that purpose addition of party is not required.  In the circumstances, we dismiss the Revision Petition without any order as to cost.
