          Complaint under Section 35 of the Consumer Protection Act, 2019

          This complaint has been received through post. Vide order dated 12.05.2022, notice was issued to the complainant for 15.07.2022, for his appearance before this Commission, to complete the requisite formalities. Clerk of this Commission has reported that notice issued to complainant through registered post not received back in any form either served or unserved but he has placed on record tracking report of the registered post whereby notice was issued to the complainant. Perusal of tracking report shows that notice was delivered to the complainant. Meaning thereby that the service upon the complainant has duly been effected. Case called several times since morning, but neither the complainant nor anybody else on his behalf appeared before this Commission. It is already 04:00 P.M. Further wait is not justified. It appears that the complainant is not interested to pursue the present complaint. Accordingly, the present complaint is dismissed in default for want of prosecution. Certified copy of the order be sent to the complainant free of costs as per rules. File be indexed and consigned to record room.
