Appeal No 236 of 2017

05.09.17     Appellant produced the F.D.R no. MTL/A 954008 dated 24.08.2017 for Rs. 5000/- drawn on Union Bank of India original F.D.R be kept in safe custody and the zerox copy on record. Heard the learned counsel for the appellant.

                   Having considered the facts and grounds stated in the petition the delay in filing of the appeal is condoned.

                   Having the learned counsel for the appellant and perused the impugned order. The complaint was dismissed with cost of Rs. 10,000/- on finding that it was based on frivolously ground. The appellant submits that during the hearing the respondent was ready to supply Kerosene oil against coupon. The District Forum has dismissed the case. No interference needed, however we are of the view that the cost of Rs. 10,000/- not justified. It is reduced Rs. 5000/-.

                   In the result, the appeal stands partly allowed at the admission stage itself.
