The complainant was a member of the scheme floated by the opposite parties in the name of Gavisiddeshwara Enterprises.  The scheme envisages payment of Rs.10000.00 in 10 monthly installments of Rs.1000/- by a every member.  The complainant has paid Rs.5000/- towards 5 monthly installments.  The remaining installments have not been paid by the complainant for which he has given an explanation in second paragraph of the com plaint.  The reason for non-payment of the remaining installments, according to the complainant, is that opposite parties are not carrying-out the scheme properly and there was a bad propaganda about the scheme.  His demand for re-payment of the sum paid as per the notice dated:
 17-05-2014 addressed to the OP No.2 has not been complied-with.  Hence the complainant has approached this Forum for refund of the amount paid together with compensation.

            2.  The terms and conditions of the scheme as printed in the book-let furnished are as follows;

1.      ಈ ಸ್ಕೀಮಿನಲ್ಲಿ ಒಟ್ಟು 3999 ಸದಸ್ಯರಿರುತ್ತಾರೆ.

2.      ಈ ಸ್ಕೀಮ್ 10 ತಿಂಗಳ ಅವಧಿಗೆ ಇರುತ್ತದೆ.

3.      ಪ್ರತಿಯೊಬ್ಬ ಸದಸ್ಯರು ರೂ.100ನ್ನು ಕಟ್ಟಿ ಸದಸ್ಯತ್ತ ನೋಂದಣಿ ಮಾಡಿಸಬೇಕು.

4.      ಪ್ರತಿಯೊಬ್ಬ ಸದಸ್ಯರು 10 ತಿಂಗಳ ಅವಧಿಗೆ, ಪ್ರತಿ ತಿಂಗಲು ರೂ.1000 ತುಂಬಬೇಕು (ಒಟ್ಟು ಮೊತ್ತ ರೂ.10000)

5.      ಮೋಟಾರ್ ಕಾರು ಮತ್ತು ಮೋಟಾರ್ ಸೈಕಲ್ ಗೆದ್ದ ಸದಸ್ಯರು ಅವುಗಳ ಆರ್.ಟಿ.ಓ. ಇನ್ಸುರೆನ್ಸ್ (ವಿಮೆ) ಮತ್ತು
              ಇತರೆ ವೆಚ್ಚಗಳನ್ನು ತಾವೇ ಭರಿಸಬೇಕು.

6.      ವಿಜೇತ ಸದಸ್ಯರು ಮುಂದಿನ ಕಂತುಗಳನ್ನು ಕಟ್ಟಬೇಕಾಗಿಲ್ಲ.

7.      ಎಲ್ಲಾ ಸದಸ್ಯರು ಕಂತಿನ ಹಣವನ್ನು ಡ್ರಾ ದಿನಾಂಕದ 10 ದಿನದೊಳಗೆ ಪಾವತಿಸಬೇಕಾಗಿ ವಿನಂತಿ.

8.      ಸ್ಕೀಮಿನ ಎಲ್ಲಾ ವಸ್ತುಗಳ ಮೇಲೆ ಆಯಾ ಕಂಪನಿಗಳ ಷರತ್ತುಗಳ ಪ್ರಕಾರ ವಾರಂಟಿ ಇರುತ್ತದೆ.

9.      ಎಲ್ಲಾ ಸದಸ್ಯರು ಒಂದು ವೇಳೆ ತಮಗೆ ಯಾವುದೇ ಡ್ರಾದಲ್ಲಿ ಬಹುಮಾನ ಸಿಗದಿದ್ದರೆ, ಕೊನೆಯಲ್ಲಿ ಯಾವ ವಸ್ತು
        ಆಯ್ಕೆ ಮಾಡಿಕೊಳ್ಳುವಿರೆಂದು ಸದಸ್ಯತ್ವ ನೋಂದಣಿ ಸಮಯದಲ್ಲಿ ತಿಳಿಸಬೇಕು.

10.     ಎಲ್ಲಾ ಸದಸ್ಯರು ಕಂತುಗಳನ್ನು ತುಂಬಿದ ತಕ್ಷಣ ರಸೀದಿಯನ್ನು ಪಡೆದುಕೊಳ್ಳಬೇಕಾಗಿ ವಿನಂತಿ ಮತ್ತು ಕೊನೆಯಲ್ಲಿ
        ಅದೃಷ್ಟ ಬಹುಮಾನ ಮತ್ತು ಸಮಾಧಾನಕರ ಬಹುಮಾನ ತೆಗೆದುಕೊಳ್ಳುವ ಸಮಯದಲ್ಲಿ ಎಲ್ಲಾ ರಸೀದಿಗಳನ್ನು
        ತೋರಿಸಬೇಕು.

11.      ಒಂದು ವೇಳೆ ಯಾವುದೇ ಸದಸ್ಯರು 2ಕ್ಕಿಂತ ಹೆಚ್ಚು ಕಂತುಗಳನ್ನು ಕಟ್ಟದಿದ್ದಲ್ಲಿ ಅವರ ಸದಸ್ಯತ್ವವನ್ನು ಯಾವುದೇ
        ಮುನ್ಸೂಚನೆ (ನೋಟೀಸ್) ಇಲ್ಲದೆ ರದ್ದುಗೊಳಿಸಲಾಗುವುದು ಮತ್ತು ಅವರ ಯಾವುದೇ ರೀತಿಯ ಹಣವನ್ನು
        ಹಿಂತಿರಗಿಸಲಾಗುವುದಿಲ್ಲ ಮತ್ತು ಎಲ್ಲಾ ಕಂತುಗಳನ್ನು (10 ತಿಂಗಳು) ತುಂಬಿದವರಿಗೆ ಈ ಕಾರ್ಡ್‍ನಲ್ಲಿ ತಿಳಿಸಿದಂತೆ
        ಸಮಾಧಾನಕರ ಬಹುಮಾನಗಳನ್ನು ಕೊಡಲಾಗುವುದು.

12.     ಯಾವುದೇ ರೀತಿಯ ಹಣವನ್ನು ಹಿಂತಿರುಗಿಸಲಾಗುವುದಿಲ್ಲ.  ಕಂಪನಿ ತೀರ್ಮಾನವೆ ಅಂತಿಮ.

13.     ಕೊನೆಯ ಡ್ರಾದ ನಂತರ 30 ದಿನಗಳೊಳಗಾಗಿ ಅವರವರ ಆಯ್ಕೆಯ ವಸ್ತುಗಳನ್ನು ಕೊಡಲಾಗುವುದು.

14.     ಯಲಬುರ್ಗಾ ನ್ಯಾಯಾಲಯ ವ್ಯಾಪ್ತಿಗೆ ಒಳಪಟ್ಟಿರುತ್ತದೆ.

15.     ಪ್ರತಿ ತಿಂಗಳು 5 ಡ್ರಾಗಳನ್ನು ಮಾಡಲಾಗುವುದು.  ಡ್ರಾದಲ್ಲಿ ಗೆದ್ದ ಸದಸ್ಯರು ಮುಂದಿನ ತಿಂಗಳುಗಳ ಕಂತು
        ಭರಿಸಬೇಕಾಗಿಲ್ಲ ಮತ್ತು ಅವರ ಸದಸ್ಯತ್ವವು ಅಲ್ಲಿಗೆ ಕೊನೆಯಾಗುತ್ತದೆ.

16.     ಮೊದಲನೆಯ ಡ್ರಾ ದಿನಾಂಕ 08.07.2012 ಹಾಗೂ ಉಳಿದ 9 ಡ್ರಾ ಗಳನ್ನು ಪ್ರತಿ ತಿಂಗಳ ಕೊನೆಯ ರವಿವಾರ
         ಸಂಜೆ: 4.30 ಗಂಟೆಗೆ ನಡೆಸಲಾಗುವುದು.

17.     3,6,9ನೇ ಯ ಡ್ರಾಗಳು ಯಲಬುರ್ಗಾದ ಶಾದಿಮಹಲ್‍ನಲ್ಲಿ ಸಂಜೆ: 4.30 ಗಂಟೆಗೆ ನಡೆಸಲಾಗುವುದು.

18.     3,6,9ನೇ ಯ ಡ್ರಾಗಳನ್ನು ಹೊರತುಪಡಿಸಿದ ಎಲ್ಲಾ ಡ್ರಾಗಳನ್ನು ಪ್ರಮೋದ ಮಂದಿರ ಕಿನ್ನಾಳ ರಸ್ತೆ, ಕೊಪ್ಪಳದಲ್ಲಿ
         ನಡೆಸಲಾಗುವುದು.

19.     ಡ್ರಾ ನಡೆಯುವ ಸ್ಥಳ ಪ್ರಮೋದ ಮಂದಿರ ಕಿನ್ನಾಳ ರಸ್ತೆ, ರೈಲ್ವೇ ಗೇಟಿನ ಹತ್ತಿರ, ಕೊಪ್ಪಳ.

3.  The scheme commenced on 08-7-2012.  The scheme ends in May – 2013.  As per the condition No. 11 and 12 amount paid in installments will not be refunded in any circumstances and those who have not get any prize during the scheme will be given consolation prize, which have to be selected within 30 days from the date of draw as per the selection of the members.  There are five consolation prizes, out of which, one has to be selected by the member.  The first consolation prize was Sony 5.1 DVD + Home Theater.  Second consolation prize was Inverter 850V.  Third consolation prize was Aid Cooler plus Maggi Mixer plus Usha Stand Fan.  Fourth consolation prize was Refrigerator Videocon 180 Lts.  The opposite parties have not delivered any of the consolation prizes, which the complainant was entitle as per the scheme within 30 days as per the conditions of the scheme.

4.  Admittedly the complainant has not paid all the installments.  Therefore, the question of providing service undertaken in terms of the scheme has not arisen.  In other words, the opposite parties are not required to deliver any of the consolation prizes.  Whatever may be the reason for non-payment of subsequent installments, the membership of the complainant stands cancelled in terms of the scheme condition No.11 cited above.

5.  In our opinion, the complainant having failed to adhere to the scheme conditions, not entitled to get the service and not entitle for refund of the amount paid as no deficiency in service would be attributed on the part of the opposite parties on the facts of the case.

6.  For what has been stated above, the complaint stands dismissed at the stage of admission.  Office to send a copy of this order to the complainant free of charges.
