The dispute involved in this complaint is regarding rental reducing in connection with annual payment scheme and with respected to excess billing.
In the light of the decision rend red by Hon’ble Supreme Court in the case of General Manger, Telecom Vs. M.Krishnan(Civil Appeal NO.7687/04) that the dispute regarding the telephone connection is to be decided by an arbitrator as provided under 7(B) of the Indian Telegraph Act, there is no jurisdiction to entertain the above complaint before the For a.
Taking in to consideration the well settled position of law that there is a special remedy provided in section 7-B of the Indian Telegraphic Act regarding disputes in respect of telephone bills, we direct the opposite parties to refer this dispute to arbitrator within two months from the date of receipt of this order, failing which the opposite parties are liable to pay `5000 (Rupees Five thousand only) as compensation to the complainant.
