Case taken up today as 10th April, 2014 was declared holiday due to General Election. The above mentioned petition pending before us relates to heft of Electricity In view of the order passed by Hon’ble Supreme Court in U.P. Power Corporation Ltd. and Ors. Vs. Anis Ahmed (Civil Appeal No. 5466 of 2012) decided on 01.07.2013, the complaint filed in the present case before the District Forum under the Consumer Protection Act, 1986, is not maintainable. Consequently, the consumer complaint filed by respondent/ complainant before the District Forum is also not maintainable. Accordingly, present revision petitions filed by the petitioners stand allowed and complaint filed by the respondent before the District Forum stand dismissed. However, liberty is granted to the respondent to seek appropriate remedy available to him before the appropriate Forum. Copy of this order be sent to the respondent. Dasti.
