Dharmendra Kumar son of Ramchandra Sao aged about 22 years, resident of Village and Police Station -Barachati, District-Gaya...Complainant.

The Branch Manager, Life Insurance Corporation of India, Branch No. 2, Swaraj Puri Road, near opposite nagmatia road, Gaya, District-Gaya...opposite Party.

                      1. The instant case has been filed by the complainant Dharmendra Kumar against the Branch Manager, Life Insurance Corporation of India for deficiency in service and to get direction for payment of ₹2 lakh at rate of 12% and also for mental agony and physical harassment ₹ 50,
on 26th June

state policy holder, filed the claim before opposite party 23rd February

                               3. On notice the opposite party appeared but did not file a Written Statement and therefore he was debarred by filing Written Statement.  Opposite Party became of absent and so the case was heard in his absent.

                               4. The main point before this Court is whether that the complainant has proved his case for deficiency in service on the part of the Opposite Party and whether he is entitled to get relief as sought for.
5. The complainant has filed evidence on affidavit and original Death Certificate ,original receiving receipt of LIC of India, original medical prescription of  Dr  BPN Singh, original application of complainant, Dead Body crimination Certificate, statement of nominee, statement of complainant, photo copy of policy Bond.
6. It appears from photostat copy of Policy Bond of  Late Munma Devi under scheme Jeevan Anand (with profits) (with accident benefit) Life Insurance Corporation of India bearing number

dated 26 June term. Now it appears from perusal of policy Bond that the insurance was commenced on 26 June . Hence, the documentary evidence present   case record shows that the complainant is entitled to get sum assured ₹2 lac from the opposite party. After perusal  of evidence on affidavit filed by the complainant and documents submitted by him we are of the opinion that is deficiency in service on the part of opposite party and due to none payment of the claim filed by the

complainant, he has got mental agony and physical harassment.

                         We, therefore, direct the opposite party to pay ₹2 lakh with interest @ 8% from the date of death of the deceased life assured Manma Devi i.e
