                                                                   ORDER

    Bereft of uncessaries, the case of complainant  Radhakrishnan  is that the L.G.Mobile phone he purchased from 2^nd opposite party on 1/9/2009 for Rs.5500/- rupees became defective within its warranty period.  Ist opposite party is manufacturer of the Mobile phone.  Though complainant entrusted the mobile phone for repair with opposite parties 3&4 the authorized service centres of Ist opposite party, the defects were recurring even after their repair.  The complainant there after caused a lawyer notice on 11/2/2010 to Ist opposite party.  But there is no response  from Ist opposite party.  Hence the complaint.

 2.   Though notices issued by registered post is served on opposite parties, none of them cared to appear and defend the complaint.  Hence all opposite parties had to be set exparte.

3.     Complainant filed proof affidavit in support of his case.  Exts.A1 to A9 marked.  Counsel for the complainant heard.  Documents perused carefully.

4.    Ext.A1 is the purchase bill of the mobile phone dtd.1/9/09.  Ext.A2 is the warranty card.  Ext.A3 is the service slip.  In Ext.A3 the defects of the mobile phone such as low voice, non working of video Camera etc are seen noted.  Ext.A4 is the copy of the lawyer notice.  All the documents produced show that the mobile phone purchased by the complainant is suffering from defects during its warranty period and it is not fit for use.  Therefore he is entitled for the relief claimed.

       Hence the complaint is allowed and the opposite parties are jointly and severally directed to refund the purchase price of the mobile phone ie, 5500/- rupees to complainant together  with a compensation of 5000/- rupees and a   cost of  2000/- rupees.  Time for compliance is limited to 30 days from the date of receipt of copy of order.  Failing which the amount  of 5500/- rupees will carry interest @12% per annum from the date of complaint till payment.
