ORDER
SRI. P. V. JAYARAJAN: PRESIDENT
This complaint is filed under Sec. 35 of the Consumer Protection Act, 2019 and the matter stood over to this date for consideration. After hearing the matter this Commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint notice was issued to the opposite party. Opposite party entered appearance and filed written version denying the allegations raised by the complainant. The case was originally posted to 30.07.2024 for filing proof affidavit of the complainant. Meanwhile, both the complainant and opposite party submitted that there is a chance of settlement and the matter has to be referred for mediation. The counsel for the opposite party filed a memo to that effect. Hence this Commission advanced this case from 30.07.2024 to this date for mediation. When the case came up for consideration today both the complainant and opposite party filed a compromise memo. As per the compromise the water connection provided to the complainant will be permanently disconnected on an online application filed by the complainant and it is further agreed that the opposite party shall waive the bill amount of Rs. 1,947/- from the complainant. The complainant further endorsed that she has no further claim in this complaint against the opposite party. The memo filed by the parties to the proceedings contains the signature of both the complainant as well as the opposite party. The compromise memo dated 15.06.2024 filed by the parties to the proceedings is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be allowed in terms of the compromise.
In the result, the complaint is allowed in terms of the compromise. The compromise memo dated 15.06.2024 shall form part of this order. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
