ORDER

By Smt. Saji Mathew, Member The gist of the Complaint is as follows: The 2nd opposite party has given a gas connection of Bharath gas from the Kalpetta Distributer. The complainant has settled all the consideration matters with the 2nd opposite party. The complainant is not getting refilled cylinders for the last 6 months. On enquiry at the gas agency, they told the complainant that the connection was transferred to Manathavady and the refilled cylinders are being taken from Manathavady. So the complainant has sustained loss and damage to an amount of Rs.10,000/-. The complainant prays for an order directing the opposite party to pay an amount of Rs. 10,000/- to him. He also prays for the reconnection of gas supply to him. 2. The opposite party were set exparte. The complainant has filed proof affidavit and document Ext. A1 and A2 were marked on the side of the complainant. 3. The matters in consideration are as follows: (1) Whether there is any unfair trade practice on the part of the opposite party.? (2) Whether the complainant is entitled to get any relief. 4. Point No.1 and 2: It is seen from Ext. A1 that the complainant has paid Rs.3,350/- to the 2nd opposite party. From Ext. A1 it is seen that cylinder is not delivered after 9.3.2008. So Point No.1 and 2 are decided in favour of the complainant. Hence the 2nd opposite party is directed to pay Rs.3,350/- (Rupees Three thousand three hundred and fifty only) to the complainant within 30 days of this order.
