ORDER

By Smt. Padmini Sudheesh, President: Petitioners are husband and wife. The complaint is for realization of amount, which are paid as the kuri instalments to the proprietor firm conducted by the respondent. The respondent was conducting a kuri firm and the petitioners were joined in kuri conducted by the respondent. The first petitioner joined three narukku of monthly deposit bearing passbook No.26, 67 and 68 and the second petitioner joined one narukku of monthly deposit bearing pass book No.27 in the 10th day monthly deposit scheme commenced on 10.1.2004 in the above scheme, monthly instalment of Rs.150/- and total of 60 instalments, having total sala of Rs.10,500/-. Now the respondent closed the firm on 19.11.2006 and proprietor is seen absconding. The firm is not functioning now. The petitioners are entitled for an amount of instalments Rs.15,600/- have paid in their monthly deposit scheme and also entitled for interest at the rate of 14% per annum for this amount Rs.1456/- from the date of closure of the respondent firm together with a future interest at the rate of 14% per annum from the date of filing of this petition till the realization of the entire amount. But the amount not returned. Hence this complaint. 2. The respondent called absent and set exparte. 3. To prove the case complainant has filed affidavit and four documents, which are marked as Ext. P1 to P4. 4. According to the complainants they are entitled for an amount of Rs.15,600/-with interest at the rate of 14% interest and also future interest.. 5. There is no evidence to the contrary. 6. In the result, complaint is allowed and the respondent is directed to return Rs.15,600/- (Rupees fifteen thousand and six hundred only) to the complainants with interest at the rate of 12% per annum from 10.11.06 till realization and pay Rs.1000/- (Rupees one thousand only) towards costs. Comply the order within one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 30th day of August 2008.
