The complainant‘s case is that the three complainant deposited a total amount of Rs. 10,50,000/- with the opposite parties.  The complainant so deposited the said amounts vide different occasions.  The opposite parties approached the complainant on diverse occasions, and handed out tempting assurances as to high rate of interest and prompt payment on demand.  The opposite parties offered 15% interest for the deposits the complainant if made.  The opposite parties issue investment certificates to the said effect to the complainant.  Subsequent to the said deposits the opposite parties paid the complainant interest for a period of next six months.  Thereafter the opposite parties did not make any payments towards interest to the complaints.  When need arose the complainants approached the opposite parties and demanded the entire deposit amount of Rs. 10,50,000/- from the opposite parties.  The complainant repeatedly requested and demanded the deposited amount through mediators and otherwise from the opposite parties.  The opposite parties till did not make it a point to release the deposit amount to the complainant.  The complainants got aggrieved on this approached this Forum for compensation and relief. 
2. Notice were duly served, and substitute steps namely paper publication was effected.  Notwithstanding this the opposite parties do not make it a point to turn up and challenge the complainants’ case.  With the result, the opposite parties were set expartie. 
3.  The 1st complainant filed proof affidavit for and on behalf of himself, and the other complainants, and the documents Ext.A1 series were marked.  As have been already observed, the opposite parties neither turned up nor contend the complainants’ case.
4.  Taking into account the complainants’ contention the issues that arise before us for consideration are:-
a) Whether the complainant deposited the amounts as claimed by them with the opposite parties?
b). Whether the complainant is entitled to any relief?
 
5.  Bearing lively in mind the complainant’s case, we carefully perused the pleadings, proof affidavit and other documents available on record.  We meticulously went though Ext.A1 series investment certificates brought on record by the complainant.  The said certificates indisputably evinces the complainants’ claim as to the factum of deposit of the amount of Rs. 10,50,000/- with the opposite parties.  What is more the opposite parties did not make it a point to turn up before this Forum nor did dispute the complainant case.  In the instant premise we are of the strong view that the complainant case stands well established.  In the context of the complainants’ consistent case and in the absence of the said case being challenged, we are lease hesitant to hold that the case of the complainants inspires confidence in the mind of this Forum.  Needless to say, the complainants are entitled to relief.  
In the result, complaint is allowed.  The opposite party is directed to pay an amount of Rs. 10,50,000/- with 12% interest from the date of institution of the instant complaint to the complainants till the recovery of the same. No order as to compensation or cost.   Order shall be complied within one month from the date of the receipt of this order.
