In this consumer complaint petitioner has prayed for refund of Rs.12,000/- and other consequential relief alleging deficiency in service on the part of the o.p.

            It is alleged by the petitioner that he made an advance of Rs.12,000/- by two cheques of Allahabad Bank, Tentulberia Branch, Garia on 12.10.07 to o.p. for a conducted tour. But the o.p. repeatedly cancelled the tour on the ground no other booking. Accordingly, petitioner demanded  refund of the amount paid. The proprietor of o.p. gave  him a cheque on 7.12.07 amounting Rs.12,000/- drawn  on Dena Bank, Kankulia Branch, Ballygunge. Thereafter petitioner tendered the cheque for encashment but no payment was made for insufficient fund. Thereby petitioner moved this forum for refund of money alleging deficiency in service on the part of the o.p.

            Notice of this consumer complaint has been duly served upon the o.p. but nobody is appearing to contest the claim of the petitioner. The contention of the petitioner is unchallenged. There is no material on record contrary to the allegation alleged in the petitioner of complaint. Accordingly petitioner is entitled to relief as prayed. The consumer complaint succeeds and it is awarded in the following terms.

            O.p. is directed to refund Rs.12,000/- (Rupees twelve thousand) only and compensation Rs.2000/- (Rupees two thousand) only and litigation cost Rs.500/- (Rupees five hundred) only within two months from date, failing which it will carry an interest @ 8% p.a. till realization.

               Let copy of this order be supplied to the parties free of cost.
