Complaint is with regard to the deficiency in service on the part of opposite party on non payment of collection charges of autorikshaw. Complainant has given her autorikshaw to the opposite party on condition that pay the collection charge of Rs.150/- per day. But the opposite party has not paid the collection amount from 26/1/2011 to 6/3/2011. The opposite party has returned the vehicle in the premises of the complainant without paying the collection amount of Rs.6,000/-
Complaint posted for hearing on admission. Heard complainant.
In the present case the complainant and the opposite party entered into contract. According to the terms of the contract the complainant has given the vehicle to the opposite party at a fixed rate per day. The matter is purely one of the description of breach of contract. In no way it amounts to consumer dispute under sec.2(1)(e) of the Consumer Protection Act. The complainant can be approach the appropriate Court.
In the result without going into the merits of the case we dismiss the complaint with direction to approach appropriate Forum for relief.
