None has appeared on behalf of the applicant.

We have perused the record.

This miscellaneous application has been filed by the applicant for releasing the amount of Rs. 25,000/-, which was deposited by the applicant towards mandatory deposit while filing First Appeal No. 255 of 2014; HDFC Standard Life Vs. Sh. Kulwant Singh Chauhan as well as an amount of Rs. 25,000/-, which was deposited by the applicant with this Commission in compliance of stay order dated 12.12.2014 passed by this Commission.  Thus, the applicant has prayed for release of total sum of Rs. 50,000/-.

The aforesaid appeal was filed by the applicant before this Commission against the judgment and order dated 04.09.2014 passed by the District Commission, Haridwar in consumer complaint No. 136 of 2014; Sh. Kulwant Singh Chauhan Vs. HDFC Standard Life.

This Commission vide order dated 24.04.2017 has dismissed the aforesaid appeal for want of prosecution in absence of the applicant, who was appellant in the appeal.

According to office report dated 12.03.2024 / 08.04.2024, in compliance of judgment and order dated 04.09.2014 passed by the District Commission, which has been confirmed by this Commission, the applicant has paid the entire decretal amount of Rs. 90,000/- to the opposite party in recovery proceedings and the District Commission vide order dated 27.03.2018 passed in execution application No. 120 of 2014, has dropped the execution proceedings in full and final satisfaction of the decree.

In view of above, the miscellaneous application is allowed.  The aforesaid amount of Rs. 50,000/- (Rupees Fifty Thousand Only) deposited by the applicant with this Commission, be released in favour of the applicant.

File be consigned to the record room along with copy of this order.
