            2.  The complainant is a landlord was let-out a shop princes to OP and the tenant, according to the complainant has not paid the rent subsequent to 12-11-2013.  It is also alleged that the complainant is selling mobile SIMS as per the rules of the OP company but the OP has not activated 15 SIMS sold by the complaint subsequent to 02-01-2014.  Therefore, the complainant seeks for a direction from this Forum for payment of arrears of the rent and also activation of 15 SIMS sold by him.  He has also alleged deficiency in service and sought for compensation of Rs.30,000/- under this head.

            3.  The transaction referred to in the complaint is a commercial transaction.  No service was undertaken by the OP to the complainant.  OP is not a purchaser of the SIMS.  Payment of rent is not a service within the meaning of Section 2(1)(O) of the Consumer Protection Act – 1986.  The transaction was only a commercial purpose and therefore the complaint is not maintainable by this Forum.

            4.  For the above reasons, the complaint is dismissed at the stage of admission.
