SRI.VIJU.V.R                           : MEMBER

1.       This complaint is filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.

2.       This is a complaint filed by the complainant against the opposite parties alleging deficiency in service. After admitting the complaint, notice was issued to the opposite parties. On the date fixed for the appearance of opposite parties the opposite parties failed to appear before this Commission. Hence opposite parties set exparte. Thereafter first opposite party filed IA.27/22 to set aside exparte order. IA allowed. Since 06.01.2020 this case is adjourned for the purpose of filing the affidavit of the complainant. As the complainant was continuously absent notice was issued to the complainant to appear before this Commission today to further proceed with this complaint. When the case came up for consideration today we find that even after accepting the notice the complainant failed to appear before this Commission. Complainant has not filed any affidavit also to prove his case. In the above discussions, we find that the complainant is not interested to further proceed with this complaint.

In the result, the complaint is dismissed for default. There will be no order as to costs.

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.

Dictated to the Confidential Assistant, transcribed by her corrected by me and pronounced in the Open court, this the 28th June 2022.
