The appellant is the complainant in CC.162/06 in the file of CDRF, Pathanamthitta.  The complaint has been dismissed on account in the failure of the appellant/complainant to produce the relevant documents.

2. It is the case of the complainant that she was allotted an extent of 372.12 sq.meter by the opposite party/Housing Board.  The complainant constructed a house therein. The plot was allotted in 1984.  According to the complainant opposite parties has demanded an amount of Rs.7,13,899/- as additional value of land which according to the complainant is not based on any basis.

          3. The evidence adduced consisted of Ext.A1 to A3.

          4. We find that the complaint was dismissed for non production of relevant documents.  Complainant has sought for an opportunity to produce documents etc.  The respondent/opposite party stood ex parte in the proceedings before the Forum.

          5. In the circumstance the order of the Forum is set aside.  The case is remitted back to the Forum with direction to dispose of the matter afresh after permitting the parties to adduce any further evidence if they so desire. The Forum shall issue notice to the opposite parties.

The matter shall stand posted before the Forum on 26.6.09. 

          Office is directed to despatch this order to the Forum urgently.
