ORDER
SRI.P.V. JAYARAJAN, PRESIDENT:
This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a case filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. The opposite party entered appearance and filed written version denying the allegations raised by the complainant against the opposite parties. When the case came up for consideration today, we noticed that the complainant is continuously absent since 09/07/2019. Inspite of giving sufficient opportunities, the complainant failed to avail those opportunities to file an affidavit and adduce evidence to prove the case of the complainant. As the complainant has not filed an affidavit or marked documents, there is no material evidence before this Commission to substantiate the allegation made by the complainant against the opposite parties. In the above circumstances we find that the complainant is miserably failed to establish his case against the opposite parties. In view of the continuous absence of the complainant we find that the complainant is not willing to further proceed with this case. Hence we find that this is a fit case to be dismissed for default.
In the result the complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
