                                    Both the parties have filed an application for taking mutual settlement on record.  The same has been signed by the parties and their respective counsel.

                                    The said application is taken on record and is marked as Ex. “X” for identification.

                                    Learned counsel for the parties and the parties submit that both these appeals may be disposed of in terms of the settlement application Ex. “X”.

We have gone through the terms of settlement as recorded in application Ex. “X”.The same is lawful.

In the circumstances as agreed by the parties and their respective counsel both the appeals are disposed of in terms of settlement application, Ex.”X”.The same shall be treated as

an order and shall be binding on the parties and enforceable between the parties as provided under The Legal Services Authorities Act, 1987.

The District Forum to release the amount of Rs.4,00,000/- out of the amount deposited with it by the opposite party – Krishna Builders in favour of the complainant.Rest of the amount out of deposited amount of Rs.5,00,000/- and Rs.25,000/- (towards pre-deposit) be refunded by the Forum to the opposite party / Krishna Builders.

The appeals stand disposed of accordingly.
