Final Order / Judgement

Present:    Complainant in person.
              Heard on the question of admission.  Briefly the averments of the complainant are that he was seeking admission in any Law School affiliated/approved with any Government recognized University/Bar Council of India.  In the month of July, 2012, OP No.1 alongwith their officials came to Mansa and called 10-12 students at Mansa and got common subject written examination against payment of Rs.100/- and thereafter took personal interview of the students.  The complainant was declared eligible.  The complainant purchased the prospectus on payment of Rs.200/- and got reserved the seat for LL.B 3 year course.  Thereafter the complainant passed the LL.B 3 year exam from the institute of OP No.1 in District Saharanpur (U.P.). It is alleged that the complainant paid all the required fee. 
               It is alleged that the opposite party has not issued original mark sheet, certificates, degree and other requisite documents to the complainant.  Hence this complaint.          
           In order to attract territorial jurisdiction of this Forum, the averments of the complainant is that he had appeared in pre-examination at Mansa in the year 2012 for LLB 3 year course.  Hence this complaint at Mansa. In support of his submissions, complainant has relied upon 1998(1) CPJ 56 Sucheta v/s Unit Trust of India and  1996(1) CPC 245 Avniben Nikhilkimar Shah v/s Khaitan Hostombe Spinels Ltd..
             Before issuing notice to the opposite parties it is to be seen whether this Forum has territorial  jurisdiction at Mansa.  As mentioned  above, the only averment of the complainant is that he appeared in pre-examination test in the year 2012 at Mansa.  There is no record to prove this fact.  Moreover, complainant has passed LLB 3 year course at Saharanpur, UP.  The Opposite party was also to issue required documents from Saharanpur or Meerut.  Keeping in view the facts of the case this Forum is of the view that no cause of action accrued at Mansa.  As such, this Forum at Mansa is not having territorial jurisdiction. Complaint stands rejected. Accordingly complaint in original alongwith copy of this order be returned to the complainant against valid receipt.  Photocopy of the complaint be retained on record.  File be consigned to record room.
