ORDER

By K. VIJAYAKUMARAN ACHARY, PRESIDENT. This complaint is filed by the complainant seeking realization of Rs.3,000/- and compensation and costs. The averments in the complaint can be briefly summarized as follows: The complainant approach the Kripa Charitable Society for the services of a maid servant for her daughter who was ill on 26.9.2006 she paid Rs.600/- as registration fee in the opp.party firm. Though they have agreed to provide a maid servant within 3 days, a maid servant was provided only after 2 weeks. She has also remitted Rs.2,400/- towards the salary of the maid servant and took the maid servant to her daughter’s house. On 19.10.2006 the maid servant left without completing the period of her service. She immediately informed the opp.party who agreed to provide the services of another maid servant. But they did not provide the services of another maid servant as agreed. Because of the acts of the opp.party the complainant suffered mental agony and the purpose for which the services of a maid servant was sought for was also not served. The amount of Rs.3,000/- paid to the opp.party for the above purpose was also lost. Hence the complaint. The opp.party was duly served and the opp.party entered appearance. But subsequently the opp.party remained absent and hence the opp.party was set exparte. No version also was filed by the oppp.party. Thereafter the complainant filed affidavit, Ext.P1 to P3 were marked. Ext.P1 is a receipt issued by the opp.party Society for having receiving Rs.6,00/- towards registration fees. Ext.P2 is the receipt for having received Rs.2400/- towards the salary of the maid servant. Ext.P3 is the extract of telephone bill of the complainant evidencing the telephone calls made by the complainant to the opp.party in this regard. From the affidavit and Ext.P1 and P3 we find that there is deficiency in service on the part of the opp.party and as such the complainant is entitled to get back the amount deposited and compensation. In the result the complaint is allowed directing the opp.party to pay Rs.3,000/- towards the amount deposited by the complainant with 18% interest per annum from 11.10.2006 till the payment and Rs.1500/- towards compensation and costs.
