Both parties file hazira through advocate.

The case is fixed for Argument. After hearing Argument from both sides the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that he applied for electric connection to his submersible pump for irrigation purpose and deposited Quotation amount of Rs.7,699/- on 02/05/2019 but the O.P. did not give the connection as applied for in spite of reminders. The Complainant has therefore approached this Commission for appropriate relief.

O.P. contested the case by filing a written version contending inter alia that Sri Kinkar Ghosh, father of the Complainant has already an existing electric connection to his submersible pump on his plot of land and the Complainant having applied for submersible pump connection on the same plot of land the prayer of Complainant cannot be considered accordingly.

-: Decision with reasons: -

Having regard to the facts of the case, contention and submission and documents on both sides the Commission finds that the electric connection to the submersible pump in close vicinity cannot be given on the same plot of land owned by the father of the Complainant. However, at the time of hearing Ld. Advocate appearing for the O.P. has submitted before the Commission that the O.P. Authority may explore the possibility of giving electric connection to the submersible pump of the Complainant if consent is given by the owner of the land i.e. his father.

Ld. Advocate for the Complainant has however assured the Commission that he will obtain necessary permission for the same. The Commission leaves the matter for consideration upon the O.P. as to viability of giving electric connection to the submersible pump of the Complainant in the vicinity of already existing connection to the submersible pump standing in the name of the Complainant’s father without any compromise with any provision of Electricity rules & regulations.

Hence it is ordered……..

That the case is disposed of on merit on contest by directing the O.P. to consider giving electric connection to the submersible pump of the Complainant on the plot of land owned and possessed by his father Kinkar Ghosh within forty five days from this date on production of consent/permission letter from said Sri Kinkar Ghosh by the Complainant subject to fulfillment of all legal formalities and relevant rules and regulation in default the O.P. will suffer penalty in accordance with law.

Both parties be supplied copy of this Judgement free of cost.
