Order Below Exh. 01 In C.C.No. 1444/2009

Complaint and his advocate are absent since long the matter has been pending for the written version of the opponent since 24/11/2009.  The complaint has not taken any step against the opponent for proceeding of the case against him without his say.  It appears that, complaint is not interested in prosecuting the matter.  As such, we had passed an order against compliant on last date on 24/5/2013 that, he shall take step; else matter would be dismissed default. Today also, neither complaint not his advocate is present.  No step taken by the complaint.  The matter is therefore, liable to be dismissed in default vide section 13 (2) (C) of the Consumer Protection Act, 1986.  Hence we pass the following order.

O R D E R

1. The complaint is dismissed in default vide Section 13 (2) (C) of the Consumer Protection Act, 1986.
  
2. Inform the parties accordingly.
